Amendment 1: Reproductive Rights

This amendment doesn't change who can practice medicine in Virginia — every provider is still bound by their scope of practice and training, just as they are today. Claiming otherwise is a scare tactic, not a fact. Abortion is already regulated in Virginia, and this amendment doesn’t change that. It simply protects the health and safety of all Virginians by ensuring that doctors and nurses can treat their patients without fear of criminal punishment due to extreme bans on reproductive health care.
  • Performing an illegal abortion in Virginia is a Class 4 felony. This applies to unlicensed individuals or abortions performed outside the legal framework.
  • Promoting or advertising illegal abortions is a Class 3 misdemeanor.
  • Hospitals and medical professionals are not required to perform abortions if they have religious or other objections.
  • Performing an abortion on a minor without proper consent is also a Class 3 misdemeanor. Minors need notarized written consent from a parent, guardian, or qualifying adult relative. Minors can seek a judicial bypass if involving their parents isn't safe or possible.
